Terms of Donation

A receipt to the donor will acknowledge the donation of items to the Friends of the Mitchell Gallery of Flight, Inc. (FOMGF).

Acceptance of all donations and loans are subject to the approval, on a case-by-case basis, by the board of directors. At no time will the FOMGF be legally bound by any special requirements for public exhibition, or any other special considerations imposed by any donor (corporate, institution or individual) unless agreed to by the board of directors in writing at the time of donation.

Upon donation, the donor relinquishes all claims to the items and understands that the FOMGF becomes the sole owner of the items. The donor makes no warranties or guarantee as to the condition or functioning of the items donated. It is further understood that the FOMGF is under no obligation or restriction regarding display, use, retention or disposition of the items. In the case of original works of authorship (unpublished manuscripts, paintings, drawings, photographs, etc.) all copyrights held by the donor are relinquished to the FOMGF.

Since the FOMGF is a nonprofit, educational institution within the scope of federal statute 501(c) (3), the value of the donated items can be considered a charitable contribution. The responsibility for establishing the value of the donated items, however, is borne entirely by the donor.
